Recently, the Ministry of Finance ("MOF") and the National Development and Reform Commission ("NDRC") have jointly issued the Announcement on Deferring the Payments of Some Administrative and Institutional Fees by Enterprises and Individually Owned Businesses (the "Announcement").

The Announcement states that, firstly, during the period from October 1, 2022 to December 31, 2022, the charging items in the List of Administrative and Institutional Fees Deferred for Payment by Enterprises and Individually Owned Businesses that are payable by enterprises and individually owned businesses should be postponed for payment for one quarter from the due date, and no late surcharge will be imposed. Secondly, the List of Administrative and Institutional Fees Deferred for Payment by Enterprises and Individually Owned Businesses includes 14 fees and charges such as farmland reclamation fees and sewage treatment fees. Thirdly, all localities, competent authorities and entities concerned should strictly follow the requirements of the Announcement and effectively implement the policy of deferred payment, to ensure that the policy is put into place.

两部门：缓缴涉及企业、个体工商户部分行政事业性收费

近日，财政部、国家发展和改革委员会共同发布《关于缓缴涉及企业、个体工商户部分行政事业性收费的公告》（下称《公告》）。

《公告》规定：一、在2022年10月1日至2022年12月31日期间，对企业、个体工商户应缴纳的《涉及企业、个体工商户行政事业性收费缓缴清单》内收费项目，自应缴之日起缓缴一个季度，不收滞纳金。二、《涉及企业、个体工商户行政事业性收费缓缴清单》包括耕地开垦费、污水处理费等14项收费。三、各地区、有关部门和单位要严格按照《公告》要求，切实落实缓缴政策，确保政策落地见效。

海关总署公布《海关过境货物监管办法》 

日前，海关总署发出《中华人民共和国海关过境货物监管办法》（下称《办法》），自2022年11月1日起施行。

根据《办法》，“来自或者运往我国停止或者禁止贸易的国家或者地区的货物”、“危险废物、放射性废物”等十类货物禁止过境。过境货物自进境起到出境止，应当接受海关监管。《办法》指出，承担过境货物境内运输的运输工具负责人，应当经国家有关部门批准开展过境货物运输业务，并按照规定在海关备案。运输工具负责人应当提交过境货物运输申报单，向进境地海关如实申报。《办法》还明确，过境货物自运输工具申报进境之日起超过三个月未向海关申报的，视为进口货物，按照海关法等法律法规的有关规定处理。

GAC Introduces Measures for Customs Regulation of Transit Goods 

The General Administration of Customs ("GAC") has recently issued the Measures of the Customs of the People's Republic of China for the Regulation of Transit Goods (the "Measures"), with effect from November 1, 2022.

According to the Measures, the goods of ten categories are forbidden to pass through the territory of China, including "the goods from or to the countries or regions with which China has stopped or forbidden trading", and "hazardous waste and radioactive waste". Transit goods shall be subject to customs regulation from entry to departure. The persons in charge of the transport vehicle that undertakes the domestic transportation of transit goods shall be approved by the relevant state department for engaging in the transit goods transportation business and shall complete record-filing with the customs in accordance with relevant regulations. The persons in charge of the transport vehicle shall submit a declaration form for the transportation of transit goods and make a truthful declaration to the customs at the place of entry. The Measures also specify that, if the transit goods have not been declared to the customs for more than three months from the date of entry declaration by the transport vehicle, they shall be deemed as imported goods and shall be handled pursuant to relevant provisions in the customs law and other laws and regulations.

“两高两部”联合发布新取保候审规定 

近日，最高人民法院等四部门联合发出《关于取保候审若干问题的规定》（下称《规定》），自印发之日起施行。

《规定》对取保候审的一般规定、决定、执行、变更、解除、责任等方面作出规定。其中，重点对以下内容进行了修改：一是进一步明确了取保候审的适用范围。二是强化对被取保候审人的执行监管。三是解决取保候审执行中遇到的具体问题。四是进一步规范取保候审的工作衔接。关于取保候审的对象，《规定》明确对于采取取保候审足以防止发生社会危险性的犯罪嫌疑人，应当依法适用取保候审。关于取保候审的适用条件，明确了对于刑事诉讼法第六十七条中的“严重疾病”和“生活不能自理”，分别参照最高法等部门印发的有关规范性文件执行。

Four authorities, including the Supreme People's Court ("SPC"), have jointly issued the Provisions on Several Issues Concerning the Release on Bail Pending Trial (the "Provisions"), with effect from the date of issuance.

The Provisions specify the general rules, decision, enforcement, change, cancellation, liability, and other aspects regarding the release on bail pending trial. Among others, revisions are mainly proposed for the following contents: (1) further clarifying the scope of application for the release on bail pending trial; (2) strengthening the enforcement and supervision of those released on bail; (3) addressing some specific issues arising from the implementation of the release on bail pending trial; (4) further regulating the work coordination for the release on bail pending trial. Regarding the targets to be released on bail pending trial, the Provisions clarify that the release on bail pending trial shall be lawfully adopted for the criminal suspects for which the release on bail pending trial is sufficient to prevent the threat to the society. Regarding the conditions for application, it is stipulated that the "serious illness" and "inability to take care of himself/herself" in Article 76 of the Criminal Procedure Law shall be subject to the relevant normative documents issued by the SPC and other authorities.

Guangdong-Macao In-Depth Cooperation Zone in Hengqin Unveils Measures to Help Enterprises Reduce Cost

近日，国务院办公厅下发《关于进一步优化营商环境降低市场主体制度性交易成本的意见》（下称《意见》）。

《意见》从五个方面部署了重点任务：一是进一步破除隐性门槛，推动降低市场主体准入成本。二是进一步规范涉企收费，推动减轻市场主体经营负担。三是进一步优化涉企服务，推动降低市场主体办事成本。四是进一步加强公正监管，切实保护市场主体合法权益。五是进一步规范行政权力，切实稳定市场主体政策预期。其中，《意见》指出，全面实施市场准入负面清单管理；着力优化工业产品管理制度，推行工业产品系族管理；规范实施行政许可和行政备案；切实规范政府采购和招投标，推动招投标领域数字证书跨地区、跨平台互认；持续便利市场主体登记，逐步实现内外资一体化服务。

Recently, the General Office of the State Council has issued the Opinions on Further Improving the Business Environment and Lowering the Institutional Transaction Costs of Market Entities (the "Opinions").

The Opinions deploy key tasks from five aspects: firstly, further removing the hidden threshold and promoting the lowering of the access costs of market entities; secondly, further regulating enterprise-related charges and promoting the reduction of the operating burden of market entities; thirdly, further improving enterprise-related services and promoting the reduction of service costs of market entities; fourthly, further strengthening fair supervision and effectively protecting the legitimate rights and interests of market entities; and lastly, further regulating administrative powers and effectively stabilizing the expectations of market entities in policies. Among them, the Opinions point out that efforts will be made to fully implement the negative list for market access management; optimize the industrial product management system and implement the administration of industrial products by product family; standardize the implementation of administrative licensing and administrative record-filing; effectively regulate government procurement and bidding and promote cross-regional and cross-platform recognition of digital certificates in the field of bidding; and continue to facilitate the registration of market entities and gradually realize integrated services for domestic and foreign companies.

New Provisions on the Release on Bail Pending Trial Jointly Introduced by Four Authorities 

The General Administration of Customs ("GAC") has recently issued the Several Measures of the General Administration of Customs for Providing Support for Comprehensively Deepening Reform and Opening-up of the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone (the "Measures").

The Measures, centering on three aspects, namely, "giving full play to Qianhai's advantages in trial and promoting the coordination between the rules in Shenzhen and Hong Kong", "giving full play to Qianhai's advantages in modern service industry and promoting the convenient flow of cross-border factors", and "building a high-level opening-up portal and supporting the development of a Shenzhen-Hong Kong comprehensive bonded zone for modern service industry", set forth 18 measures, including supporting Qianhai to build a big data service platform for cross-border trade, and building "soft connectivity" between the institutional rules of Shenzhen and Hong Kong. Among others, the Measures call for relying on the "single window" for international trade, developing a big data platform for cross-border trade in Qianhai on a trial basis, and strengthening the mining and application of big data; launching the pilot program for "one document for two submissions" in Shenzhen and Hong Kong, supporting the China-Singapore (Shenzhen) cross-border trade data international interconnectivity project, piloting electronic bill of lading, and promoting the realization of cross-border data interconnectivity, mutual recognition of documents, and mutual regulatory assistance.

证监会公布修订后QFII、RQFII交易结算规定 

日前，中国证券监督管理委员会发布《关于合格境外机构投资者和人民币合格境外机构投资者境内证券交易登记结算业务的规定》（下称《规定》），自公布之日起施行。

本次《规定》的主要修订内容包括：一是根据《合格境外机构投资者和人民币合格境外机构投资者境内证券期货投资管理办法》，修改制定依据，将人民币合格境外机构投资者（RQFII）纳入适用范围。二是根据DVP改革要求，修改超买情形下中国结算违约处置具体规定，改为中国结算按照相关业务规则处理。三是根据实际工作情况，调整关于错误交易防范及责任分担的三方协议的备案要求。《规定》的发布实施，进一步夯实了DVP改革的制度规则基础，理顺了相关制度衔接。

The China Securities Regulatory Commission ("CSRC") has recently issued the Provisions on the Domestic Securities Trading, Registration, and Clearing Businesses of Qualified Foreign Institutional Investors and RMB Qualified Foreign Institutional Investors (the "Provisions"), with effect from the date of issuance.

The Provisions mainly propose the following revisions: (1) revising the formulation basis pursuant to the Administrative Measures for Domestic Securities and Futures Investment Made by Qualified Foreign Institutional Investors and RMB Qualified Foreign Institutional Investors, and including the RMB qualified foreign institutional investors ("RQFIIs") in the scope of application; (2) based on the requirements for DVP reform, revising the specific provisions for CSDC's handling of overbuying circumstance by requiring CSDC to handle the overbuying pursuant to relevant business rules; and (3) adjusting the requirements for the record-filing of the tripartite agreement that specifies the prevention of erroneous trading and the sharing of responsibilities. The promulgation and implementation of the Provisions further consolidate the institutional foundation for DVP reform and clarify the coordination of relevant rules.

CSRC Issues the Revised Trading and Clearing Rules for QFIIs and RQFIIs 

近日，海关总署发布《海关总署支持前海深港现代服务业合作区全面深化改革开放若干措施》（下称《若干措施》）。

《若干措施》从“发挥前海先行先试优势，推进深港规则对接”、“发挥前海现代服务业优势，促进跨境要素便捷流动”、“打造高水平对外开放门户枢纽，支持建设深港现代服务业综合保税区”等三个方面，确立支持前海建设跨境贸易大数据服务平台、开展深港两地规则制度“软联通”合作等18条举措。其中，《若干措施》提出，依托国际贸易“单一窗口”，在前海试点建设跨境贸易大数据平台，加强大数据挖掘与应用；试点深港“一单两报”，支持中新（深圳）跨境贸易数据国际互联互通项目，试点提单电子化，推动实现跨境数据互联、单证互认、监管互助等。

信安标委就《信息安全技术 网络数据分类分级要求》征意 

近日，全国信息安全标准化技术委员会发布《信息安全技术 网络数据分类分级要求（征求意见稿）》（下称《征求意见稿》），面向社会征询意见，意见反馈截至11月13日。

《征求意见稿》给出了数据分类分级的原则和方法，包括数据分类分级基本原则、数据分类框架和方法、数据分级框架和方法等。其适用于行业领域主管（监管）部门参考制定本行业本领域的数据分类分级标准规范，也适用于各地方、各部门开展数据分类分级工作，同时还可为数据处理者进行数据分类分级提供参考。《征求意见稿》提出，根据数据在经济社会发展中的重要程度，以及一旦遭到泄露、篡改、破坏或者非法获取、非法利用，对国家安全、公共利益或者个人、组织合法权益造成的危害程度，将数据从高到低分为核心、重要、一般三个级别。

NISSTC Seeks Comments on the Information Security Technology — Requirements for Classification and Grading of Network Data 

Recently, the National Information Security Standardization Technical Committee ("NISSTC") has released the Information Security Technology — Requirements for Classification and Grading of Network Data (Draft for Comment) (the "Draft for Comment") for public comments by November 13, 2022.

The Draft for Comment sets out the principles and methods of data classification and grading, including the basic principles of data classification and grading, framework and methods of data classification, framework and methods of data grading, etc. This standard is applicable to situations where the competent (regulatory) department of an industry formulates the standard and specifications for data classification and grading in the industry or field, or where various localities and departments carry out data classification and grading activities, and is also used as a reference for data processors to conduct data classification and grading. The Draft for Comment states that, data is classified into three categories from high to low: core, important, and general, according to the importance of data in economic and social development, and the degree of harm to national security, public interest, or the legitimate rights and interests of individuals and organizations once it is leaked, tampered with, destroyed, or illegally obtained or used.

财政部明确新增下达增值税留抵退税转移支付预算事项 

日前，财政部发布《关于新增下达增值税留抵退税转移支付预算的通知》（下称《通知》）。

《通知》提出，为支持地方落实好“批发和零售业”等7个行业新增留抵退税政策，中央财政2022年一次性新增下达增值税留抵退税转移支付预算。《通知》进一步明确，该项补助参照《新出台留抵退税政策专项资金管理办法》进行管理，纳入直达资金范围，省市县均可留用，标识为“01中央直达资金”，该标识贯穿资金分配、拨付、使用等整个环节，且保持不变。收到本《通知》后7日内，研究提出资金分配方案报送财政部备案，在报送的备案文件中，除反映资金分配结果外，还应反映分配原则、分配办法、资金投向、预期效果等。

MOF Clarifies Matters Concerning Additional Budgets for Transfer Payment for Refund of Uncredited Input VAT 

The Ministry of Finance ("MOF") has recently released the Circular on Assigning Additional Budgets for Transfer Payment for Refund of Uncredited Input VAT (the "Circular").

The Circular calls for supporting each locality to newly implement the policies for the refund uncredited input VAT in seven industries, including "wholesale and retail industry". The central finance will assign additional budgets for transfer payment for refund of uncredited input VAT on a one-time basis. The Circular further clarifies that the subsidies shall be subject to the Administrative Measures for the Special Funds under the Newly Introduced Policies for Refund of Uncredited Input VAT, and shall be included in the scope of directly allocated funds, which may be retained and used by provinces, cities, and counties. They shall be labelled as "01 directly allocated central funds", which shall be used in all processes ranging from fund allocation, appropriation, and utilization and be kept unchanged. Within seven days upon receipt of this Circular, a fund allocation plan shall be introduced upon study and be submitted to the MOF for record-filing. Fund allocation principles, method, destination, and the expected effect will be specified in the record-filing materials, in additional to the fund allocation results.

国家发改委等印发《养老托育服务业纾困扶持若干政策措施》 

日前，国家发展和改革委员会等多部门联合发布《养老托育服务业纾困扶持若干政策措施》（下称《政策措施》）。

《政策措施》涵盖房租减免措施、税费减免措施、社会保险支持措施、金融支持措施、防疫支持措施和其他。其中，《政策措施》提出，养老服务机构和托育服务机构属于中小微企业和个体工商户范畴、承租国有房屋的，一律免除租金到2022年底。教育、科研等系统的有关单位和机构出租房屋的，鼓励其对养老托育服务小微企业和个体工商户进行租金减免。《政策措施》规定，2022年，各地对符合条件的养老托育服务机构按照50%税额顶格减征资源税、城市维护建设税、房产税、城镇土地使用税、印花税（不含证券交易印花税）、耕地占用税和教育费附加、地方教育附加等“六税两费”。

Recently, the National Development and Reform Commission ("NDRC") and other authorities have jointly issued Several Bailout and Support Policies for the Elderly Care and Childcare Service Industry (the "Policies").

The Policies include, among others, rent relief measures, tax relief measures, social security support measures, financial support measures, and support measures for epidemic prevention. Among them, the Policies state that elderly care and childcare service institutions that are categorized as micro, small and medium-sized enterprises and individually owned businesses shall be exempted from paying the rent on the state-owned houses they have rented, until the end of 2022. Relevant entities and institutions in the system of education and scientific research that rent out houses are encouraged to offer rent reductions or exemptions for small and micro enterprises and individually owned businesses engaged in the elderly care and childcare services. The Policies further stipulate that, in 2022, eligible elderly care and childcare service institutions in all regions will enjoy 50% reduction in the payment of "six types of taxes and two types of surcharges", i.e., resource tax, urban maintenance and construction tax, real estate tax, urban land use tax, stamp duty (stamp duty on securities transactions exclusive), cultivated land occupation tax and education surcharge, and local education surcharge.

国家网信办公布《数据出境安全评估申报指南（第一版）》 

日前，国家互联网信息办公室发出《数据出境安全评估申报指南（第一版）》（下称《指南》）。

《指南》旨在指导和帮助数据处理者规范、有序申报数据出境安全评估。其对数据出境安全评估申报方式、申报流程、申报材料等具体要求作出说明。数据处理者因业务需要确需向境外提供数据，符合数据出境安全评估适用情形的，应当根据《数据出境安全评估办法》规定，按照《指南》申报数据出境安全评估。《指南》明确，数据处理者向境外提供数据，有“关键信息基础设施运营者和处理100万人以上个人信息的数据处理者向境外提供个人信息”等情形之一的，应当通过所在地省级网信办向国家网信办申报数据出境安全评估。

CAC Issues the Guide on Application for Security Assessment of Outbound Data Transfers (First Edition) 

Recently, the Cyberspace Administration of China ("CAC") has issued the Guide on Application for Security Assessment of Outbound Data Transfers (First Edition) (the "Guide").

The Guide, which aims to guide and help data processors to standardize and orderly apply for security assessment of outbound data transfers, clarifies the specific requirements for the application methods, process and materials for such assessment. If an outbound data transfer of a data processor is truly necessary due to business needs and falls within the circumstances where the security assessment of outbound date transfers applies, the data processor should, subject to the provisions of the Measures for the Security Assessment of Outbound Data Transfers, apply for security assessment according to the Guide. The Guide also clarifies that, for an outbound data transfer by a data processor that falls under the listed circumstances including "outbound transfer of personal information by a critical information infrastructure operator or a personal information processor who has processed the personal information of more than one million individuals", it should apply to the CAC for the security assessment via the local provincial-level cyberspace authority.

Recently, four authorities including the Ministry of Industry and Information Technology ("MIIT") have issued the Implementation Plan for "Increasing Varieties, Improving Quality, and Creating Brands" in Raw Materials Industries (the "Plan").

The Plan sets the main objective through 2025 and the long-range objectives through 2035 according to the "supply-led, market-oriented, innovation-driven and benchmarking model" principles. By 2035, the supply capacity and level of raw material varieties and service quality will be greatly improved, reaching the level of advanced economies in the world, and a group of enterprises and product brands with excellent quality, obvious advantages and core intellectual property rights will be created. To achieve the development objectives, the Plan has established nine key tasks from the perspective of increasing varieties, improving quality, and creating brands. Among them, in terms of increasing varieties, the following tasks are specified: to develop green and low-carbon products, carry out energy-saving and carbon-reduction and green transformation and upgrading, and vigorously develop energy-saving and carbon-reduction technologies such as carbon capture; to strengthen the implementation of green product evaluation standards, publish the encouraged applied technologies and product catalogs orienting towards green and low-carbon directions, and accelerate the development of a unform green product standard, certification, and mark system. The Plan also deploys three key projects: cultivation of improved varieties of raw materials, improvement of the quality of raw materials, and building of raw materials brands.

四部门印发《原材料工业“三品”实施方案》 

近日，工业和信息化部等四部门制发《原材料工业“三品”实施方案》（下称《方案》）。

《方案》按照“供给引领、市场主导、创新驱动、标杆示范”原则，提出2025年主要目标和2035年远景目标。到2035年原材料品种供给能力和水平、服务质量大幅提升，达到世界先进国家水平，形成一批质量卓越、优势明显、拥有核心知识产权的企业和产品品牌。《方案》按照发展目标，从增品种、提品质、创品牌三方面提出9项重点任务。其中，在增品种方面，明确发展绿色低碳产品，开展节能降碳和绿色转型升级改造，大力发展碳捕捉等节能降碳技术。强化绿色产品评价标准实施，发布绿色低碳方向鼓励推广应用技术和产品目录，加快建设统一的绿色产品标准、认证、标识体系。《方案》还部署了原材料品种培优、原材料品质提升、原材料品牌建设三项重点工程。

商务部决定建立商贸物流企业重点联系制度 

MOFCOM to Establish a Liaison System for Key Commercial and Logistics Enterprises 

日前，商务部办公厅下发《关于建立商贸物流企业重点联系制度的通知》（下称《通知》）。

《通知》从完善联系机制、发挥带动作用、加强动态管理等方面做出部署。《通知》要求，各地商务主管部门要引导重点联系企业积极参与商贸物流高质量发展专项行动，完善商贸物流服务网络，提升城乡配送服务水平，推进物流标准化、智慧化、绿色化建设。《通知》明确，重点联系企业可参与供应链创新与应用示范创建、县域商业体系建设、农产品供应链体系建设、一刻钟便民生活圈试点、商品市场优化升级等工作，充分发挥示范带动和创新引领作用。《通知》还一并公布了2022年首批287家全国商贸物流重点联系企业。

Recently, the General Office of the Ministry of Commerce ("MOFCOM") has issued the Circular on Establishing a Liaison System for Key Commercial and Logistics Enterprises (the "Circular").

The Circular makes arrangements from improving the liaison mechanism, playing a leading role, and strengthening dynamic management. The Circular requires that local commerce authorities should guide key enterprises in liaison with authorities to actively participate in the special action for high-quality development of commerce and logistics, improve the commercial and logistics service network as well as urban and rural distribution services, and promote the standardized, intelligent, and green development of logistics. The Circular clarifies that key enterprises can participate in the building of supply chain innovation and application models, the development of county-level commercial systems, the building of agricultural product supply chain system, the pilot program of quarter-hour convenient life circle, and the optimization and upgrading of commodity markets, and give full play to role of leading the demonstration and innovation. The Circular also announces the first batch of 287 key commercial and logistics enterprises nationwide in 2022.

Recently, the China Banking and Insurance Regulatory Commission ("CBIRC") and the People's Bank of China ("PBC") have issued the Guiding Opinions on Promoting the Healthy Development of Financing Business Based on Movables and Rights (the "Opinions").

The Opinions propose that, efforts will be stepped up to provide services for movables- and rights-based financing, reasonably expand the scope of collaterals, give play to the role of movables- and rights-based financing in supporting the weak areas, and strengthen the differentiated management of movables- and rights-based financing. Banking institutions are supported in their efforts to deepen innovation in the financing business based on movables and rights, improve the quality and efficiency of accounts receivable financing services, optimize financing business based on commodities and property in goods, develop supply chain-based accounts receivable financing and other businesses, and develop systematic, full-scenario digital supply chain financial products. The Opinions require that banking institutions should improve the risk management and control capabilities of movables-based financing, strengthen the valuation of movables and rights, and implement classified credit management, and may explore the "three inspections" system for the supply chain financing business in which the investigation and review activities are mainly conducted online. Banks are also required to put in place the security registration and publicity requirements, regulate the management of pledged movable assets and third-party supervision cooperation, promote the application of new technologies in the management of collaterals, and expand the channels for the disposal and realization of movable assets.

两部门发文推动动产和权利融资业务健康发展 

日前，中国银行保险监督管理委员会、中国人民银行发出《关于推动动产和权利融资业务健康发展的指导意见》（下称《意见》）。

《意见》提出，要加大动产和权利融资服务力度，合理拓宽押品范畴，发挥动产和权利融资对薄弱领域的支持作用，加强动产和权利融资差异化管理。支持银行机构深化动产和权利融资业务创新，提升应收账款融资服务质效，优化商品和货权融资业务，发展基于供应链的应收账款融资等业务，开发体系化、全场景数字供应链金融产品。《意见》要求，银行机构要提升动产融资风险管控能力，强化动产和权利价值评估，实施分类信贷管理，对于供应链融资业务，可探索以线上为主开展贷款“三查”工作。要落实担保登记公示要求，规范在押动产管理和第三方监管合作，推进新技术在押品管控中的应用，并拓宽动产处置变现渠道。

市场监管总局公布企业落实食品安全主体责任监督管理规定 

SAMR Releases Provisions on the Supervision and Administration of the Fulfillment of Main Responsibilities on Food Safety by Enterprises 

近日，国家市场监督管理总局发布《企业落实食品安全主体责任监督管理规定》（下称《规定》），自11月1日起施行。

《规定》要求，健全企业责任体系；完善风险防控机制；明确履职保障措施；完善相关法律责任。根据《规定》，企业要建立基于食品安全风险防控的动态管理机制，制定食品安全风险管控清单，建立健全日管控、周排查、月调度工作机制。《规定》明确食品生产经营企业等有食品安全法规定的违法情形的，食品生产经营企业及其主要负责人无正当理由未采纳食品安全总监、食品安全员提出的否决建议的，属于食品安全法实施条例第七十五条规定的故意实施违法行为的情形；对于食品安全总监、食品安全员已经依法履职尽责的，不予处罚。

Recently, the State Administration for Market Regulation ("SAMR") has issued the Provisions on the Supervision and Administration of the Fulfillment of Main Responsibilities on Food Safety by Enterprises (the "Provisions"), with effect on November 1, 2022.

The Provisions require improvement of the corporate responsibility system as well as the risk prevention and control mechanism, clarification on the supporting measures for performance of duties, and enhancement of relevant legal liability. According to the Provisions, enterprises should establish a dynamic management mechanism based on food safety risk prevention and control, introduce a list for food safety risk management and control, and establish and improve the working mechanism for daily management and control, weekly inspection, and monthly scheduling. The Provisions clarify that, if any food producer or distributor has committed any violations as set forth in the Food Safety Law, and the food producer or distributor and its person in charge reject the veto recommendation put forward by the food safety director or food safety officer without justifiable reasons, such act shall be considered as deliberately committing illegal acts stipulated in Article 75 of the Implementing Regulations of the Food Safety Law; and the said food safety director or food safety officer who has fulfilled his/her duties according to law will not be punished.

三部门发文加大支持科技创新税前扣除力度 

近日，财政部等三部门联合发布《关于加大支持科技创新税前扣除力度的公告》（下称《公告》）。

《公告》规定，高新技术企业在2022年10月1日至2022年12月31日期间新购置的设备、器具，允许当年一次性全额在计算应纳税所得额时扣除，并允许在税前实行100%加计扣除。凡在2022年第四季度内具有高新技术企业资格的企业，均可适用该项政策。企业选择适用该项政策当年不足扣除的，可结转至以后年度按现行有关规定执行。同时，《公告》明确，现行适用研发费用税前加计扣除比例75%的企业，在2022年10月1日至2022年12月31日期间，税前加计扣除比例提高至100%。

Three authorities, including the Ministry of Finance ("MOF"), have jointly released the Announcement on Increasing Pre-tax Deduction for Supporting Sci-tech Innovation (the "Announcement").

The Announcement specifies that, for the equipment and appliances newly purchased by high-tech enterprises during October 1, 2022 and December 31, 2022, the expenses are allowed to be deducted in full in the current year on a one-time basis when calculating taxable income, and an extra 100% pre-tax deduction is allowed. This policy will be applicable to all enterprises with high-tech enterprise qualification in the fourth quarter of 2022. If an enterprise chooses to enjoy this policy and the deduction is insufficient in the current year, the balance may be carried forward to subsequent years and the existing relevant regulations may still be applicable. Meanwhile, the Announcement clarifies that, for enterprises that currently enjoy pre-tax deduction for R&D expenses at the ratio of 75%, the pre-tax deduction ratio will be increased to 100% during the period from October 1, 2022 to December 31, 2022.

近日，海关总署印发《支持广州南沙深化面向世界的粤港澳全面合作若干措施》（下称《若干措施》）。

《若干措施》涵盖促进大湾区要素便捷流动，增强国际航运物流枢纽功能；支持重点项目建设，助推重大战略性平台发展；支持建设中国企业“走出去”综合服务基地，促进国际经济合作；加强粤港澳三地规则衔接，支持打造高质量城市发展标杆等四个方面举措。其中，《若干措施》提出，支持跨境电商业务发展。优化跨境电商进出口商品退货管理，深化跨境电商零售出口退货“合包”措施运用，支持南沙符合条件的企业开展跨境电子商务零售进口退货中心仓业务。加快出口海外仓企业备案，实施“一地备案，全国通用”，支持跨境电子商务企业出口海外仓业务发展。

GAC Introduces Measures to Support Nansha, Guangzhou in Deepening the World-oriented All-round Cooperation among Guangdong, Hong Kong and Macao 

The General Administration of Customs ("GAC") has recently issued the Several Measures for Supporting Nansha, Guangzhou in Deepening the World-oriented All-round Cooperation among Guangdong, Hong Kong and Macao (the "Measures").

The Measures cover the initiatives in four aspects, including facilitating the flow of factors in the Greater Bay Area and strengthening the function of international shipping and logistics hub; supporting the building of key projects and promoting the development of major strategic platforms; supporting the construction of comprehensive service bases for Chinese enterprises to "go global" and promoting international economic cooperation; strengthening the connection of rules in Guangdong, Hong Kong and Macao, and supporting the building of high-quality urban development benchmark. Among others, the Measures call for supporting the development of cross-border e-commerce. Efforts shall be made to optimize the return management of import and export commodities under cross-border e-commerce business, deepen the application of "package" measures in cross-border e-commerce retail export returns, and support eligible enterprises in Nansha to engage in center warehouse business for cross-border e-commerce retail import and return; accelerate the record-filing for overseas export warehouse enterprises, adopt the approach of "one-place record-filing and nationwide application", and support the development of overseas export warehouse business conducted by cross-border e-commerce enterprises.
